Policy Alert: Purchasing, Bidding and Bonds.

Policies of a school district, especially those negotiated with bargaining representatives for the protection of teachers, have the full force and effect of law, and legally bind the school district. Wessington Springs Ed. Assoc. v. Wessington springs Sch. Dist., 467 N.W. 2d 101 (S.D. 1991).

The ASBSD Policy Review Committee completed work on many policies dealing with purchasing, bidding and bonds.

 

Those amended policies include:

  • DJ: Purchasing Procedures
    • Sample policy DJ was renamed from Purchasing to Purchasing Procedures;
    • Current sample policy DJF (Purchasing Procedures) was incorporated into the newly renamed sample policy DJ (Purchasing Procedures);
    • DJF (Purchasing Procedures) was removed from ASBSD sample policies;
    • “The amended policy includes definitions, general rules regarding purchasing, adds expenditures from federal grants funds and gives a brief explanation as to the various methods which schools can use for purchasing,” ASBSD Director of Policy & Legal Services Gerry Kaufman said.
  • DJC: Bidding Requirements
    • “Sample policy DJC was completely rewritten,” Kaufman said.
    • Sample policy DJC now includes specific information on:
      • Definitions
      • Competitive Sealed Bids
      • Competitive Sealed Proposals
      • Advertising for Bids and Proposals
      • Awarding Contracts
      • Contracts Exempt from Bidding.
  • FEFB: Bonds for Public Improvement Contracts
    • Sample policy FEFB was renamed from Contractor’s Affidavits and Guarantees to Bonds for Public Improvement Contracts.
    • Sample policy FEFB sets forth:
      • Bid Bond requirements applicable to construction of public improvements,
      • Performance Bond requirements applicable to construction of public improvements or furnishing material or labor for the improvements.
