Policy Alert: Federally Required Annual Notices and Policies

Policies of a school district, especially those negotiated with bargaining representatives for the protection of teachers, have the full force and effect of law, and legally bind the school district. Wessington Springs Ed. Assoc. v. Wessington springs Sch. Dist., 467 N.W. 2d 101 (S.D. 1991).

The National School Boards Association/Council of School Attorneys (NSBA/COSA) 2018 Annual Notices and Policies Required by Federal Law has recently been posted.

 

The Annual Notices include recommendations from the U.S. Department of Education regarding the notices applicable to FERPA (Family Educational Rights and Privacy Act), which governs disclosure of confidential student information and PPRA (Protection of Pupil Rights Amendment), which requires school districts to have policies regarding surveys of students, instructional materials, physical examinations, personal information used for marketing, etc., related to students.

The Policies Required by Federal Law includes the ESSA requirement for a policy prohibiting certain employment recommendations in cases of sexual misconduct.
