ASBSD updating criminal background check sample policy

Recently, the South Dakota Division of Criminal Investigation updated the criminal background check process, which is being required by the FBI.

 

ASBSD’s Executive Director Wade Pogany, Director of Policy & Legal Services Gerry Kaufman and Director of Communications Tyler Pickner met with DCI Identification Specialist Jami Oakland and DCI Identification Section Leader Angela Smith. Oakland and Smith had held regional, on-site training for schools and other political subdivisions of the new rules and requirements.

 

Following ASBSD’s meeting with DCI staff, Kaufman emailed a number of questions to DCI regarding the new FBI rules and requirements, which DCI was going to forward to the FBI.

 

A primary concern of schools and ASBSD is the DCI/FBI requirement that requires schools to have written policies outlining the disqualifiers for employment and the employment applicant appeal process for challenging the criminal background report.

 

Oakland told ASBSD the DCI criminal background check user audits would not begin until September 1, 2017, and schools should have an updated policy in place by the end of August, 2017.

 

ASBSD is in the process of amending its sample Background Check Policy, GCDB, and the amended ASBSD sample policy will be available to ASBSD member schools on or before July 31, 2017.
