Policy Alert: Student and Staff Health and Safety

Policies of a school district, especially those negotiated with bargaining representatives for the protection of teachers, have the full force and effect of law, and legally bind the school district. Wessington Springs Ed. Assoc. v. Wessington springs Sch. Dist., 467 N.W. 2d 101 (S.D. 1991).

 

Student and staff health and safety related policies recently received rewrites.

 

The four sample policies amended, include:

  • GBE: Staff Health and Safety:
    • Changes made to the health and safety certification of employee and workers compensation reporting procedure;
  • GBEB and GBEB-R(1): Employee Communicable Diseases:
    • Removes the reference to advisory committee and updates the process of determining if an employee may be affected with a communicable disease and how that information is distributed and reported;
  • JHC: Student Health:
    • Amended language related to health services;
  • JHCC and JHCC-R(1): Student Communicable Diseases:
    • Removes the reference to advisory committee, revises the process of determining if a student may be afflicted with or have been exposed to a communicable disease and how that information is distributed and reported, and added requirements to report the disease to the South Dakota Department of Health.

ASBSD’s Policy team reviewed the sample policies and updated the processes included within each,” ASBSD Director of Policy and Legal Services Jessica Filler said.
