Policy Alert: Delinquent Student Fees, Fines and Charges

Policies of a school district, especially those negotiated with bargaining representatives for the protection of teachers, have the full force and effect of law, and legally bind the school district. Wessington Springs Ed. Assoc. v. Wessington springs Sch. Dist., 467 N.W. 2d 101 (S.D. 1991).

ASBSD’s Policy Services team approved a new sample policy and an accompanying exhibit:

  • JNB:  Delinquent Student Fees, Fines and Charges
  • JNB-E(1): Delinquent Student Fees, Fines and Charges – Small Claims Court Information

The new sample policy addresses the all-to-often issue of attempting to collect delinquent fees, costs, and fines.

 

“The Board, through the policy, authorizes the business manager to file a Small Claims Complaint after certain criteria is met,” ASBSD Director of Policy & Legal Services Gerry Kaufman said, adding “the related exhibit provides information related to the Small Claims procedure.”
