Policies of a school district, especially those negotiated with bargaining representatives for the protection of teachers, have the full force and effect of law, and legally bind the school district. Wessington Springs Ed. Assoc. v. Wessington springs Sch. Dist., 467 N.W. 2d 101 (S.D. 1991).
Five sample school board policies were recently amended by the ASBSD Policy committee.
“The five sample policies were amended with terminology updates or changes recently made to state and federal law,” ASBSD Director of Policy and Legal Services Jessica Filler said.
The five sample policies amended, include:
- AH: Conflict of Interest Disclosure and Authorization:
- Removed reference to a local service agency;
- BD: School Board Meetings:
- Updated teleconference roll call vote procedure to coincide with change made to state statute during the 2021 legislative session;
- DJ: Purchasing Procedures:
- Adjusted the limit for bidding for public improvement contracts to $100,000, up from $50,000, in accordance with the change made during the 2020 legislative session;
- FEFB: Bonds for Public Improvement Contracts:
- Amended the bid bond amount for public improvement contracts to match the increase made in state statute during this year’s legislative session;
- JECA: Admission of Resident Students:
- Includes the update made to state statute during the 2021 legislative session related to the admission of military children to a distance learning program.
