Resident district notification bill reaches Gov.

A bill clarifying the notification by a student to their resident district of their plans to return reached the governor’s desk.

 

Senators passed House Bill 1114, which establishes certain requirements for students enrolling in resident school districts or assigned schools after participating in open enrollment, on a 27-6 vote.

 

HB 1114 allows a student who has open enrolled out of their resident district to return to the resident district as long as they notify the district by August 1. The affected school board or boards can permit a student transfer to the resident or other district after the deadline should special circumstances exist.

 

“We’re seeking the permission that you (student) notify the resident district that you’re coming back (to the district),” Sen. Deb Peters said during her comments on the Senate floor.

 

“If the student chooses to return they notify their resident school district (by Aug. 1).”

 

Sen. Peters noted the bill would ensure districts have “adequately planned for” the student’s return prior to the school year and clarifies the legal question as it relates to the student’s return to their resident district after open enrolling out of the district the previous school year.

 

“I hope this helps clear up some of the issues we’ve had,” Sen. Peters said.

 

ASBSD supports the bill, which now heads to Gov. Dennis Daugaard for review and signature.
